Brittany Martin, a pregnant Black woman who is serving four years in prison for her behavior at racial justice protests, will have her sentence reconsidered.
El Paso Inc. reports that Brittany Martin, a South Carolina resident, was found guilty of breaching the peace in a high and aggravated manner over comments she made to police at a racial justice protest. Martin’s lawyers now request a shorter sentence due to increasing concerns about her and her unborn child.
Advocates with Black Voters Matter have started a petition calling for Martin’s release. Civil rights attorney Bakari Sellers has also joined the effort.
In 2020, Brittany Martin moved from Iowa to South Carolina in protest of the police-related deaths of Breonna Taylor and George Floyd, which gave the Black Lives Matter Movement its impetus. She also had a personal motive because the police shot and killed her brother-in-law and her son.

Britanny Martin was captured on body camera during a police protest, but the prosecutors in the case failed to prove her grabbing or even touching the cops. She was ultimately cleared of instigating a riot, and the jury returned a not guilty decision about whether she had threatened the lives of law enforcement.
The Conviction of Brittany Martin
Brittany Martin was only found guilty by the jury of violating the peace, which carries a maximum sentence of 30 days in jail and a $500 fine. Prosecutors, however, described the case as a “serious and aggravated offense,” which is punishable by up to ten years in jail. Martin’s lawyer, Sybil Dione Rosado, also claims that Judge Kirk Griffin did not permit her to discuss the distinction and the likelihood that Martin would receive a considerably worse sentence.
In a statement, Sellers called the sentence “beyond the pale.”
“The fact is you have people who stormed the Capitol, who led to the death of law enforcement, who tried to overturn an election and fracture democracy. And they’re getting two months, three months, six months,” Sellers told El Paso Inc.
“And Brittany Martin gets four years.”
Of the 850 people charged with federal charges in connection with the Capitol Riot on January 6, more than 330 have entered pleas of guilty and were given less time than Martin, which is a reflection of how outrageous her sentence is.
Whitney Martin, Martin’s sister, claims that her body is unable to feel at ease and that despite being pregnant, she has lost 12 pounds. Rosado referred to the fact that she was recently placed in solitary confinement for refusing to get her dreadlocks trimmed as “racially biased.”
